Facilities Design Study (FDS)
ERCOT and TSP (Transmission Service Provider) assess required facilities. Identifies Direct Facilities (DF) and Network Upgrades (NU). 45-day window. Developer pays actual study costs.

Generator Interconnection Agreement (GIA)
Negotiated directly with TSP. Not FERC tariff-driven — PUCT tariff governs. 30-day execution window after FDS. Financial security posted with TSP before construction.

ERCOT's Unique Regulatory Position

ERCOT operates largely outside FERC jurisdiction. Texas's intrastate exemption under FPA §201(b). Rate cases go to PUCT in Austin, not FERC in Washington. Key implication: project developers cannot appeal ERCOT decisions to FERC — only Texas courts and PUCT.

The Public Utility Commission of Texas (PUCT) approves ERCOT market rules, transmission buildout (via CPCN filings), and generation interconnection tariff. Five commissioners appointed by the Governor. Major restructuring occurred post-Winter Storm Uri (2021).

Energy-Only Market
ERCOT uses a scarcity-pricing energy market rather than a capacity market. LMPs can reach $5,000/MWh (price cap) driven by the Operating Reserve Demand Curve (ORDC). No separate capacity auction unlike PJM or MISO. Project economics depend entirely on energy + ancillary service revenues.

CREZ Transmission (2013)
Competitive Renewable Energy Zones — $6.9B statewide transmission buildout completed 2013. 2,334 miles of new 345kV lines from West Texas wind zones to load centers. Completed on time and under budget. Enabled 18,000 MW of West Texas wind. Single most transformative interconnection policy in US history.

Nodal Market (since 2011)
ERCOT operates ~8,500 pricing nodes. LMPs differentiate by node — projects in congested areas face basis risk (negative LMPs possible in West Texas). Storage and wind projects must model nodal basis carefully. CRR (Congestion Revenue Rights) market exists but capacity is often insufficient.
